By accessing or using ProofPop (“the Service”), operated by Linfordy LLC, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

ProofPop is a SaaS platform that helps businesses collect, verify, and display customer social media posts as social proof. The Service includes customer outreach via SMS and email, AI-powered post verification, embeddable website widgets, and Google Business Profile management tools.

3. Account Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 18 years old to use the Service.
• One person or business may not maintain more than one free account.

4. Acceptable Use

You agree not to:

• Send unsolicited or spam messages through the Service
• Submit fraudulent or fabricated social media posts
• Use the Service to harass, abuse, or harm others
• Attempt to reverse-engineer, decompile, or hack the Service
• Violate any applicable laws or regulations
• Impersonate another person or business

5. Customer Data

You are responsible for obtaining proper consent from your customers before adding their contact information to the Service and sending them messages. You must comply with all applicable laws regarding electronic communications, including the Telephone Consumer Protection Act (TCPA) and CAN-SPAM Act.

6. Intellectual Property

The Service, including its design, code, and branding, is owned by Linfordy LLC. You retain ownership of your business data and content. By using the Service, you grant us a license to use your content solely for the purpose of providing the Service.

7. Payment and Billing

• Paid plans are billed monthly or annually as selected.
• Payments are processed securely through Stripe.
• You may cancel your subscription at any time. Access continues until the end of the billing period.
• Refunds are handled on a case-by-case basis.

8. Limitation of Liability

To the maximum extent permitted by law, Linfordy LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

9. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure.

10. Termination

We may suspend or terminate your account at any time for violation of these terms. You may delete your account at any time by contacting us. Upon termination, your data will be deleted in accordance with our Privacy Policy.

11. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the new terms.
